Insurance Question?

In: Automotive Insurance

19 Apr 2010

I was a passenger in a one car accident a few days ago. Although it was a pretty bad accident, me and the driver were both pretty much unscathed. Ambulances’ escorted us to the hospital for safety precautions I guess. I was x-rayed and had a CAT scan. I do not have health insurance. The driver has full coverage automobile insurance. Will his insurance company pay for my hospital bill?
Thanks for the answers. My dad’s first cousin is a lawyer and he’s going to contact him before anything. I know the bill is going to be a lot and I don’t have the money to pay it so I’m really hoping the bill gets covered.

If his insurance finds him at fault- yes. (Which im assuming they will- it being a one car accident.) This would fall under his “bodily injury” coverage on his policy. Make sure you call his insurance and confirm a claim was reported and let them know you were injured.

Maybe. Depending upon the state he should have medical or PIP (personal injury protection) to cover him and passengers in his car. This coverage is an option and is not included in what most people call “Full Coverage”.

You have 2 potential options.

1. If your friend’s auto policy has med pay coverage – you can pursue through that. OR, if it’s a PIP/No Fault state – you can get your meds and any wage loss through that coverage.

2. if your friend’s auto policy does not have med pay and it is NOT a PIP/No Fault state – you CAN pursue a bodily injury claim against your friend’s policy – and if you only want the hospital bill paid – tell them that – they should be able to do that no problem (as long as liability is adverse to your friend), and you would have to sign a Release in order to receive payment.
