How can i negotiate a settlement claim for an auto injury with usaa insurance?

USAA insurance company only wants to give me $1000.00 & my daughter $700.00 for our injuries due to their insureds boyfriend who did a burn out in a puddle of water and rear ended me. We hurt our backs and necks but they are somewhat better for the most part. At least a few days a week we still have to deal with some pain, or stiffness, soreness. The adjuster isnt even paying me for my time off from work. What should I do????I know we could get more but I dont want to hire a lawyer, plus I only have until this June 19, 2006 to do something. Help!!! I want to be able to write some sort of letter sounding like I know what I’m talking about.

Ouch! When no void comes to a settlement with insurance, your best best would get a injury lawyer. In most case you will WIN and don’t have to pay a lawyer one cents. Check with the law bar in San Fransico and ask the clerk to find you good rate lawyer who wins win. Hopefully they will have someone contact you. Good luck, i would file, because I had to in the past when I was in a car accient and it was the cop fault. Had to sue the city!

The best advise I can give on this is to deal directly with USAA and only submit claims from Doctors visits and time lost. Some try to get money that exceeds the amount that the insurance compnay sees as resonable claims. Insurance companies will however discuss any claim that you feel is less that what you deserve. If you contact the company and do not attempt to go through the lawyers you will have better luck with the claims adjuster. Make sure that you communicate through writing and have your adjuster communicate in writing. Write a letter to the adjuster and send it with any doctors visits and information about lost time at work. Make the letter formal and polite and ask if the adjuster can respond in kind. a lot of it is all about documentation. if the doctor wrote you off work, get a note from him and submit it to the insurance company. get proof of time off from your work to help document this. the more documentation you provide the more they know and the more they realize you have a substantial claim. also, how long ago was the accident? depending on the state, usually the statute of limitations is a year or 2…i would look it up online by your state and lookup “statute of limitations”. this is important, because if push comes to shove, you have until the date of per the statute of limitations to file a claim with the courts. USAA could just be telling you a date they would like to have the claim resolved, not the date your statute is up.
