Automobile insurance comprehensive claim question. Help!!!!?

In: Automotive Insurance

10 Apr 2010

I live in Gastonia, NC and have a comprehensive insurance claim in process. The value of the car is 11,650.00 and the estimate on the claim is 8,705.49. What are my options and rights? The damage is very close to being 75% of the value of the car. I am not out to take advantage of anyone, but I work hard for what I have and I want to be absolutely sure I am not cheating myself. Can someone with experience with this situation, the laws or work in the field please help me? Your help is much appreciated.

If the car is not “totalled,” then you can get a few estimates for the repair….They will give you an average.

If the car is totalled, then you need to show them evidence that it is worth more than their estimate. Their job is to pay as little as they can, your job is to show that the car is worth more.

The insurance company ALWAYS has the right to “make you whole” at the least possible expense. That means they have the right to repair if in fact it would cost less to repair than to total the car. IF they were to total the car they the car would be theirs, and they would give you the “blue book” value for the car less your deductible.
Insurance laws differ from state to state but I suspect that my statement above is going to be pretty accurate no matter where you are.
I definitely would take my car to “my own” body shop however to reassure myself that the estimate for repair is accurate. I’m guessing that the companies damage appraiser has established the $8,705.49 and he’s probably accurate but you should make sure for your own satisfaction.
